Utah’s Sexual Battery Code

The statute states that the criminal conduct is touching someones private areas under circumstances the actor knows or should know would cause the person being touched to be alarmed. However, if the offense culminates into a rape, forcible sexual abuse, aggravated sexual assault, or a number of other crimes then it is no longer a sexual battery and the person can only be charged with the more serious offense. In Utah the offense of sexual battery is a class A misdemeanor.
